1. Acceptance of Terms

By accessing and using DS Labs services or website (dslabs.site), you accept and agree to be bound by these Terms and Conditions. If you do not agree, please discontinue use of our services.

2. Services

DS Labs provides digital solutions including website development, mobile app development, software development, AI automation, UI/UX design, e-commerce solutions, web hosting and domain registration services.

3. Subscription Plans & Minimum Commitment

All website subscription plans carry a minimum commitment period of 24 months. By subscribing to any of our plans, you agree to pay for the full 24-month period. Early termination within this period does not entitle you to a refund of remaining months.

After the initial 24-month period, subscriptions continue on a month-to-month basis unless cancelled with 30 days' written notice.

4. Payment Terms

• All prices are in Indian Rupees (INR) and inclusive of applicable taxes unless stated otherwise.
• Payment is due within 7 days of invoice issuance.
• Late payments may result in service suspension after 15 days of non-payment.
• We reserve the right to change pricing with 30 days' advance notice to existing clients.

5. Intellectual Property

Upon full payment of all dues, the client owns the custom code and design created for their project. DS Labs retains the right to showcase the project in our portfolio unless otherwise agreed in writing.

DS Labs retains ownership of any proprietary frameworks, tools or libraries used in the development.

6. Client Responsibilities

The client agrees to:

• Provide accurate information, content and timely feedback
• Not use our hosting services for illegal, harmful or spam activities
• Not attempt to access other clients' data or our infrastructure without authorisation
• Keep login credentials confidential

7. Hosting & Uptime

While we strive for 99.9% uptime, we do not guarantee uninterrupted service. Scheduled maintenance windows will be communicated in advance. Downtime caused by client actions, third-party services or force majeure events is excluded from our uptime guarantee.

8. Limitation of Liability

DS Labs shall not be liable for any indirect, incidental, special or consequential damages arising from the use of our services. Our total liability shall not exceed the amount paid by the client in the 3 months preceding the claim.

9. Termination

DS Labs reserves the right to terminate services immediately if the client violates these terms, engages in illegal activities or fails to make payment after due notice.

10. Governing Law

These Terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of courts in Ahmedabad, Gujarat, India.

11. Changes to Terms

We may update these Terms at any time. Continued use of our services after changes constitutes acceptance of the revised Terms.
